Manufacturer’s Limited Warranty

1. Limited Warranty

1.1 The Manufacturer warrants the Tiny House against defects in craftsmanship, workmanship, and structural integrity (“Manufacturer’s Works”) for a period of three years from the date the Tiny House leaves the Manufacturer’s Premises for delivery to the Client (“Warranty Period”).

1.2 The Manufacturer may undertake repairs or replacement in respect of the Manufacturer’s Works at its sole discretion in respect of defects arising under normal and proper use or from faulty materials or workmanship provided that written notice from the Client of the defect is received by the Manufacturer within the Warranty Period.

1.3 No claim shall be accepted under the Limited Warranty if any attempt to repair the Tiny House has been made by the Client or any other person or entity not authorised to do so by the Manufacturer, or if the Tiny House has been modified or incorrectly maintained or used.

1.4 If the Manufacturer agrees to undertake repairs or replacement in respect of the Manufacturer’s Works then such repair or replacement will be as reasonably specified by the Manufacturer. The Client is liable for all transport and freight relating to the repair or replacement.

2. Exclusions from Limited Warranty

2.1 Appliances included in the Tiny House: 

a) The Client acknowledges that the appliances included in the Tiny House are manufactured by or sourced from a party or parties other than the Manufacturer and that such appliances are covered by their respective manufacturer’s warranties. 

b) No warranty is given by the Manufacturer in respect of the appliances including components of appliances which are found to be damaged or defective.

2.2 Please note that this limited warranty is subject to certain limitations, particularly in sea spray zones, coastal environments, or areas affected by industrial contamination or geothermal sulphur.

2.3 The remedies outlined in this limited warranty are the sole and exclusive remedies available to the Client in respect of the Manufacturer’s Works.

2.4 The limited warranty does not cover product failures or defects resulting from the following:

a) Client Neglect: Damage resulting from abuse, misuse, neglect, failure to provide proper maintenance (including but not limited to cleaning gutters, touching up paint, pest control), or failure to maintain proper ventilation, humidity, and heat levels within the Tiny House.

b) Normal Wear and Tear: Deterioration of construction materials within expected levels, including warping or shrinkage within industry standards, or changes due to weather conditions, natural disasters, or soil movement or settling.

c) Cracking of Paint: For the avoidance of doubt, cracking paint constitutes normal wear and tear due to uneven ground surface or differential expansion/contraction of materials caused by temperature and humidity fluctuations.

d) Third-Party or Natural Events: Damage caused by third parties, “Acts of God” (e.g., earthquakes, floods, fire, animals, or lightning strikes), or any other uncontrollable external events.

e)Client Alterations: Damage resulting from alterations, additions, or repairs made to the Tiny House by the Client or any third party hired by the Client, including but not limited to any housing costs, living expenses, or other disruptions incurred during necessary repairs.

f) Appliances and Equipment: Home appliances such as refrigerators, ovens, dishwashers, washing machines, and califonts are covered by warranties provided by their respective manufacturers.

g) Improper Maintenance or Relocation: Damage caused by improper maintenance, including failure to empty pipes during the absence of the Client, or damage during transportation or relocation of the tiny home.

3. Disclaimer and Limitation of Liability

3.1 The limited warranty is exclusive and the only warranties made by the Manufacturer with respect to the Tiny House. No other express warranties, whether written or verbal, are made or authorised by the Manufacturer.

3.2 In no event shall the Manufacturer be liable for incidental, consequential, or indirect damages of any kind, including but not limited to lost profits, business interruption, commercial loss, or any other damage arising from the use, misuse, or failure of the Manufacturer’s products, to the fullest extent permitted by applicable New Zealand law.
